Can I Stop The Other Parent From Taking My Child Overseas ?

Yes, overseas travel is a guardianship decision under the Care of Children Act 2004 that requires the agreement of all guardians. If a parent plans to take your child overseas without your consent, you can make an urgent application to the Family Court to stop them. If you have grounds to believe your child is about to be taken out of New Zealand, contact me urgently to discuss immediately legal intervention.

My Ex Won’t Let Me See The Kids

Under the Care of Children Act 2004 children are entitled to a meaningful relationship with both parents, if contact is being denied, you can apply to the Family Court for a Parenting Order which sets out child care arrangements specifying contact time. Generally, you will first be required to attempt to resolve your dispute through Family Dispute Resolution (FDR) Read my Parenting Plans & FDR Guide for a complete breakdown of the mandatory steps.

Emergency Applications Involving Child Safety or Family Violence

Urgent court intervention may be required where there is an immediate risk to a child or your personal safety.

We act for clients seeking urgent family court orders including:

  • urgent child custody and day-to-day care
  • orders preventing children from being removed from New Zealand

Applications are prepared and filed as part of formal legal representation only.

Urgent custody and care of children applications.

Children exposed to violence, neglect, drugs or serious mental health concerns, may require an urgent parenting order placing the child in the day to day care (formerly known as child custody) of a safe parent.

The court may require the other parent’s contact with the children to be supervised until the children’s safety concerns are addressed.

These matters require precise preparation and persuasive evidence.

Why Self-Filing Urgent Applications Are Dangerous

Urgent applications that are incomplete, poorly drafted, or unsupported by evidence are frequently declined.

When this occurs, the other party becomes aware of the attempt & reads everything you have said about them, this often escalates risks & reduces future chances of success.

Engaging experienced representation maximises the likelihood that urgent orders are granted the first time.
